A nursing home committed elder abuse resulting in the wrongful death of a 65-year-old resident. In addition to $2.9 Million in compensatory damages and attorney’s fees, the court awarded $6 Million in punitive damages.
A 91-year-old woman fell repeatedly in an assisted living facility. On the last occasion, she fractured her shoulder and passed away while being hospitalized for her injury.
An 82 year old woman was transferred to a Monterey Nursing Home following a surgery which paralyzed her. She entered the nursing home with small bed sores, one of which became far worse while at the nursing home. When the nursing home finally transferred her back to the hospital it was only because the pressure sore on her coccyx had become fist sized and was infected. She suffered a number of hospitalizations over many months because of the severe exacerbation of her bed sore’s condition which she claimed was from the nursing home’s abuse and neglect.
A middle-aged woman suffering from severe multiple sclerosis sued her nursing home for dependent adult neglect and abuse arising out of the development of pressure sores (decubitus ulcers). Significant discovery and investigation revealed that the nursing home had failed to follow doctor’s orders, failed to follow California regulations, as well as its own policies and procedures regarding preventing skin problems and treating residents with pressure sores.
Recovery for a family whose 88 year old mother died as a result of a nursing homes’ failure to maintain adequate staffing. Because of various medical problems, the mother was unable to self hydrate, and nursing home staff failed to assist her. She became severely hydrated and suffered renal failure, leading to her death.
Settlement awarded to a woman who was sexually abused by nursing home staff, where it was contended that the nursing home should have been aware of the staff’s potential to abuse the woman.
The family of an elderly gentleman who was suffering from severe, long term diabetes, renal failure, cardiovascular disease, and cancer and sued the nursing home. The nursing home’s neglect resulted in multiple falls and fractured bones to this man, which the family contended hastened his death.
A dependent adult who entered the nursing home with severe pressure sores and skin problems successfully prosecuted his case of neglect and abuse as a result of the nursing home’s failure to properly treat his skin problems, leading to alleged infections and hospitalizations. This gentleman was not only successful in his lawsuit, but was able to leave the nursing home and is now living independently.
A 91 year old gentleman was attacked by another resident of an assisted care facility resulting in a neck injury which required surgery. The facility failed to effectively isolate the dementia patient who attacked our client even though it was aware of his capacity for attacking other residents.
